Federal Guidelines Drug Quantity Chart
For evaluating the sentencing liability of your narcotics clientele.
This chart is taken from the United States Sentencing Guidelines Chapter 2D1.1 subsection (c). The guidelines themselves and the offense level assigned to a particular drug weight are advisory. With narcotics cases, the statute (under 21 U.S.C. 841(b)) is more important than the guidelines. That’s where you may find mandatory minimums, which are not advisory. Federal criminal narcotics sentencing is complex. This chart is just one part of it.
For many years, the Federal Defenders of Eastern Washington and Idaho have published an indispensable Little Red Rules Book which I always carry in my briefcase. It goes with me to court, jail visits or is within reach at my desk. It’s terrific. If you want one, you can order it. The one thing that does not have is a fentanyl/fentanyl analogue chart. If you practice law in the world of federal narcotics cases these days, you know that might come in handy. Maybe we will need to add nitazenes to it soon. 😣
