NACDL is tracking the rise of unusual and expanding USDOJ prosecution activity.
The NACDL recently launched something federal defense attorneys should be paying attention to: a Criminal Case Tracker designed to identify and analyze federal prosecutions that depart from traditional enforcement norms.
This is a curated watchlist of unusual, novel, or expansive applications of federal criminal law and the kind of cases that distinguish themselves from long-standing enforcement patterns. There’s also an interface to recommend cases you may know about that meet these criteria.
When I think federal prosecutors might be experimenting with new or creative theories, it is sometimes hard to detect the big picture. Is it new, new to my district or just new to me? Because today’s USAO outlier may become tomorrow’s standard practice, this NACDL tracker could be a great way to keep a handle on what’s going on nationally and push back where possible.
